The California Birthday Rule

A yearly opportunity for California Medicare Supplement policyholders to switch policies without answering health questions.

How it works

Your birthday starts the window

Each year, a 60-day window begins on your birthday.

Choose equal or lesser benefits

Switch to a Medigap policy with the same or fewer benefits, from the same or a different company.

No health questions

The insurer can’t deny the new policy or price it based on your health.

Who it applies to

  • California residents who already have a Medicare Supplement (Medigap) policy.
  • It does not apply to Medicare Advantage plans or Part D plans.
  • It is set by California law (Insurance Code section 10192.11).

Important limitations

  • You can only move to a plan with equal or lesser benefits — not to a plan with more benefits.
  • Outside protected windows, insurers may ask health questions.
  • Never cancel your current policy until the new one is approved.

Your first and broadest opportunity to buy Medigap is the six-month Medigap Open Enrollment Period that starts when you’re 65 or older and enrolled in Part B. Learn about Medigap.
